  PRESIDENT SIGNS REPEALING OUTDATED DEALER CERTIFICATION MANDATE  
  On June 9, 2014, the President signed into law an NADA-backed bipartisan bill unanimously passed by Congress which repeals a 1977 mandate requiring auto dealers to provide light-duty new vehicle purchasers with a form certifying compliance with the Clean Air Act. The certification language was redundant with disclosures in the owner's manuals and under-hood stickers of light-duty vehicles. Leading the charge on the bipartisan legislation were U.S. House Reps. Bob Latta, R-Ohio, and Gary Peters, D-Mich., and Sens. Debbie Stabenow, D-Mich., and Deb Fischer, R-Neb. 

The U.S. Environmental Protection Agency technically still has a "dealer certification" rule on its books. However, given that the underlying statutory mandate has been repealed, NADA takes the position that the rule is no longer enforceable and dealers do not need to comply with it. 

We are pleased that in a year when little legislation is passing, NADA was successful in championing the passage of this paperwork reduction legislation for dealers into law.

About the presenter: 

Ed Pudlowski
Ed Pudlowski is the Chief Operating Officer and Senior Health and Welfare Plan Consultant for American Fidelity Administrative Services (AFAS). Ed has more than 30 years of experience in developing human resource philosophies and supporting strategies to improve employer's return on their investment in human capital. Prior to joining American Fidelity Administrative Services, Ed was a Partner with Ernst & Young where he led the employer strategy task force on Health Care Reform. He has also worked for two large employee benefit consulting firms as well as a large health insurance company. Ed is a frequent speaker on health care reform and other health and welfare plan issues and has published several articles in national business magazines covering health care reform, financial risk in human resources and quality in health care. Ed holds a BS in Applied Mathematics from Indiana University of Pennsylvania. He is an Associate of the Society of Actuaries, a member of the American Academy of Actuaries, and a Fellow of the Conference of Consulting Actuaries (CCA). Ed also holds a position on the CCA's Board of Directors and its Healthcare Reform Community Group. 

Kelli Personette
Kelli Personette is a Health Care Reform Consultant with American Fidelity Administrative Services. Her exclusive responsibility is helping employers with Health Care Reform. Kelli monitors developments in the law, makes presentations to association groups, and works one-on-one with employers to help them understand the rules, develop their strategies, and assist with compliance. Prior to coming to American Fidelity Administrative Services, Kelli has worked in the Public School setting by placing children in Learning Disabled and Emotionally Handicapped placements. She has also worked in the Medical Device Field helping with Health Care Reform in the medical market. Kelli holds a B.A. from the University of Notre Dame in Psychology and Sociology and has over 15 years of experience in health care management, pharmaceuticals, and patient care.

  REMINDER TO PARTICIPATE IN THE DEALERSHIP WORKFORCE STUDY  
  To accommodate numerous requests from dealer members, the deadline to participate in the 2014 Dealership Workforce Study (DWS) was extended to June 30, 2014. Dealers are encouraged to submit their data as soon as possible in advance of the deadline to allow for the extensive data review process.

The DWS is the only NADA-ATD study that compares dealership compensation and benefits, retention and turnover and hours of operation to aggregated peer data. With the results, dealers can make data-based decisions on recruiting, hiring and motivating employees. Only NADA and ATD members are eligible to participate, and there is no cost.

It's easy to participate. There are separate processes for single dealership and dealer group enrollments. Further, participants in the 2013 study will find the survey conveniently pre-populated with their previous answers, which can be changed as necessary. Finally, this year's reports will be sent directly to the person identified as report recipient. Reports will be sent as soon as they are available. 

Each participating dealership will receive a complimentary, customized Basic Report comparing its data against data aggregated on a regional and national basis-plus a complimentary, comprehensive Dealership Workforce Study Industry Report. 

Participants can also purchase a customized Enhanced Report, which further compares individual dealership data against data for the franchise and state. Additional customized group reports are available, as is the Compensation and Tenure Search Tool, which enables ad hoc searches, including searches by dealership or dealer groups. A dealership provided a demo vehicle to a new salesman on his first day of work. That night, the new employee took three friends for a ride in the car, and wound up getting into a single-car accident. One passenger lost sight in both eyes.
