  Meet Your New IADA Chairman, Jack Schmitt  
  Jack Schmitt, President of Jack Schmitt Family of Dealerships, in O'Fallon, Illinois was elected the 2017 Chairman of the Board of the Illinois Automobile Dealers Association, during its annual meeting for the election of officers held in Chicago.
 
He has been in the automotive business for over fifty years. Jack currently owns four dealerships, the Jack Schmitt Family of Dealerships which represents Chevrolet, Cadillac, Ford and Lincoln with locations in O'Fallon, Collinsville and Wood River, Illinois. He bought his first Chevrolet-Oldsmobile dealership in 1959 with his brother in law, Jack Weir in Nokomis, Illinois. In 1976, Jack joined the IADA Board of Directors and has been a NADA PAC President's Club Member for over 25 years.

In the industry, Jack has been a leader of franchised dealers in his local community. He has been a Board Member and or Chair-person in each of the following: Belleville Chamber of Commerce, Belle-Scott Committee, Commerce Bank, Metro East Advisory Board, Belleville Rotary Club, Leadership Council of St. Clair and Madison County and Past President of the Mid American Chevy Dealers Association.

Jack is proud to support several local programs, events and charities including: Art on the Square, YMCA, Hoyleton Children's Home, Operation Homefront, American Cancer Society, Scott Air Force Base, Boy Scouts of America, and Collinsville Charities for Children. He has received many awards and recognition for his service including: Ford Distinguished Service Award, Cadillac Excellence Award, Time Magazine Quality Award Nominee, Chevrolet Mark of Excellence, and the Boy Scout Outstanding Citizen Award.

Jack and his wife, Evelyn, reside in Belleville, Illinois. The automobile industry has been a large part of the Schmitt family as Jack's father, William, was a Chevrolet dealer from 1929-1961. Both of Jack and Evelyn's children, Kathy Federico and John Schmitt are active in the daily operations of the stores in the Family of Dealerships. Additionally, their son in law, Bob Federico is a Chrysler, Dodge, Jeep and Kia dealer in Wood River. Two of their grandchildren also work at the Federcio dealerships.

On behalf of our IADA membership, we congratulate Jack Schmitt on his dedication to our industry and we look forward to working with him as your 2017 IADA Board Chairman.

  Congratulations to 2016 Past Chairman, Sam Roberts  
  On behalf of the IADA Board of Directors and Staff we offer our congratulations to Past Chairman, Sam Roberts, Roberts Motors, Inc., in Alton, Illinois for his outstanding service and leadership to IADA during his term as Chairman in 2017. Sam will be recognized by membership during the IADA-CATA annual Spring Conference to be held in Orlando, Florida, March 29-April 2, 2017, at the Waldorf Astoria.

  Senate Bill 2037-Repeal of Sunday Closing Law-We Oppose  
  SYNOPSIS

For the 4th consecutive year, Senator Oberweis has introduced legislation to repeal the provision in the Vehicle Code that prohibits the sale of motor vehicles on Sunday.  This year's version, Senate Bill 2037, allows for the sale of vehicles by dealers on Sundays if the dealer chooses to close his or her dealership on another day of the week.

 BACKGROUND

In 1982 the Illinois Legislature enacted Sunday closing legislation for licensed automobile dealers as part of the regulatory process to obtain a dealer license.  This legislation was appealed to the Illinois Supreme Court, and was upheld as "part of a regulatory scheme" that regulates automobile dealers differently from other businesses.  Because the regulations were considered reasonable in promoting the public welfare as a part of the licensing of automobile dealers the language was upheld.

In June of 1984, the Illinois Supreme Court refused to reverse its decision, and in October of 1984 the U.S. Supreme Court refused to hear an appeal.  Repeal legislation introduced in the late 1980's was defeated.

ANALYSIS
  • The purchase of a motor vehicle is usually the second biggest purchase consumers make in their lifetimes.  It's a complicated transaction and approximately 80% - 90% of vehicles involve financing and verification of credit.  With most banks closed on Sunday it's best for consumers and dealerships to complete the transactions when financial institutions are open and customers identity and creditworthiness can be verified. 
  • Reducing employee turnover is important for any business, especially new vehicle dealerships.  Being able to spend time with their families on Sunday is important to dealership salespeople.  This enables dealerships to hire quality people who want to make a career in the retail auto industry.
  • It's not as if consumers are unable to browse dealer's lots on Sunday.  In fact, many do, and love to look around on their own.  Most consumers also shop online and can view dealer inventories at any time of day or night. 
  • Many dealer and manufacturer websites are now available 24/7, which allow customers to research vehicle prices and features online.  The average number of dealership visits by vehicle purchases has decreased from 4.5 to 1.5 as most customers now conduct the bulk of their research before walking into a dealership.  In fact, many customers like to browse dealership lots on their own on a Sunday while the dealership is closed. 
  • Opening on Sundays would not increase the number of vehicles sold in Illinois.  Instead, SB2037 would increase dealership operating costs, thereby increasing vehicle prices and reducing sales.
 COMMENTS

The Illinois Automobile Dealers Association representing 800 franchised new car and truck dealers and the Chicago Automobile Trade Association oppose Senate Bill 2037.  For further information, contact Joe McMahon at (217) 753-0220.

  NADA 2017 Convention and Expo - Illinois Dealers Recognized  
  Congratulations to the following dealers in our state who were recognized at the centennial NADA Annual Convention & Expo this past month in New Orleans: Gary Knight, Katie Hopkins, and Mark Scarpelli.

IADA's Board Member and Past Chairman, Gary Knight, Carmack Car Capitol in Danville, was chosen to represent our state in the national competition for the TIME ALLY Dealer of the Year Award. The TIME dealer of the Year program honors new-car dealers in America who exhibit exceptional performance in their dealerships and perform distinguished community service.

We would like to recognize Katie Hopkins, Truck Centers Inc., Troy, as she was chosen as ATD Truck Dealer of the Year Nominee. It is a wonderful experience and honor to be recognized as the runner up nominee in a strong field of ATD members.

Our heartiest congratulations to Mark Scarpelli who was elected as the 2017 NADA Chairman. He is the President of Raymond Chevrolet and Raymond Kia in Antioch, IL.

  NADA/FTC Webinar on revised Buyers Guide - Feb 16th  
  As you are likely aware, the FTC recently announced revisions to the Used Car Rule Buyers Guide that are effective January 27, 2017.  This has raised numerous questions from dealers, ATAEs, and others about how to properly create, complete, and use the revised guide.   NADA has issued several guidance memos to our members, and we are updating our Dealer Guide to the Used Car Rule. 
 
In addition, on February 16th NADA will be hosting a webinar with John Hallerud, an attorney with the FTC who is the staff point person on the revised Buyers Guide.  The webinar will be held from 1:00-2:15 pm EST, and will feature a brief presentation and extensive time for Q&A.  ATAEs and their staff (as well as other dealer compliance professionals and forms providers) are eligible to be able to participate in this webinar - click here to register.
 
I know there are lots of good questions out there, and this is a chance to ask them directly to the FTC.

  KPA: OSHA 300A Summary Form Posting Required  
 
Under the OSHA Recordkeeping regulation (29 CFR 1904), employers are required to prepare and maintain records of serious occupational injuries and illnesses using the OSHA 300 Log.  Beginning February 1st and ending April 30th, a summary of the injuries/illnesses entered on the 2016 OSHA 300 Log is required to be posted using "OSHA Form 300A - Summary of Work-Related Injuries and Illnesses."  Other than a few exempt industries most are required to comply with recordkeeping requirements.
