  Happy Memorial Day!  
  Memorial Day is a time to remember those who served...all gave some, some gave all!  On behalf of the Board of Directors and Staff of Illinois Automobile Dealers Association, we want to wish you a happy and safe Memorial Day!

  Illinois Legislature in Final Days of Spring Session  
  IADA has two pieces of legislation which are still pending legislative action.  Dealer contacts are needed on both bills as we make a final push during the last few days of the Illinois General Assembly.  Adjournment date is May 31st.

Senate Bill 1687 (pending in the Illinois House) provides for several important changes to the Illinois Vehicle Franchise Act that are needed to assist in balancing the power between the auto manufacturer and the franchised dealer. See our Fact Sheet for details.  Please contact your State Representative immediately and urge him or her to SUPPORT Senate Bill 1687. (Contact House Member).

HB 1560  Passed the Senate today. The bill provides for several changes to the recently enacted Used Vehicle Implied Warranty of Merchantability legislation, which should be beneficial to dealers in complying with the new law which becomes effective July 1, 2017. See our Fact Sheet for details. This bill will now go to the House for concurrence and should be considered next week. (Contact House Members).

With the Budget Process, the Retailer's Discount was going to be capped at $1,000 a month and as of today, it has been removed for consideration.

  IADA Legislative Conference  
  IADA's annual lobby day on May 16th attracted some sixty-five people who attended the luncheon and over 200 legislators, legislative staffers and friends of the industry who attended the Legislative Reception/BBQ held at the IADA offices overlooking the state capitol.

Speaking at the event included:  IADA Chairman Jack Schmitt, O'Fallon; Senate Transportation Chairman Marty Sandoval (D) Chicago; Rutt Bridges, who spoke on the potential disruptive impact autonomous cars could have in the future and Jamie Auffenberg, NADA Director who updated everyone on the latest legislative and regulatory issues pending in Washington. Peter Sander, IADA President discussed pending legislative issues affecting the dealer body before the Illinois General Assembly. Dealers were well represented by those who came and met with their elected officials.

  OSHA Delays Injury and Illness Electronic Reporting Date  
  The Occupational Safety and Health Administration (OSHA) is delaying the July 1, 2017 deadline by which certain dealerships must electronically file their 2016 employee workplace injury and illness records. Dealerships required to report electronically by filing From 300A or equivalent include: 
  • Commercial truck dealerships with 20 to 249 employees at a single "establishment." "Establishment" is defined by OSHA as a single location where business is conducted or where services or industrial operations are performed.
  • Light-duty and commercial truck dealerships with 250 or more employees at a single "establishment."
Note that light-duty dealerships with fewer than 250 employees at a single "establishment" are required to record workplace injuries and illnesses, but are not required to submit Form 300A to OSHA. 

Until a new deadline is announced, covered dealerships should not file any Form 300As. OSHA may be considering the possibility of doing away with the electronic reporting mandate altogether.
