  Legal Update: Illinois Income Tax Rates Increase Effective July 1, 2017  
  On Thursday, the Illinois General Assembly overrode the Governor's veto to enact legislation to increase the Illinois income tax rate from 3.75% to 4.95% for individuals and from 4.8% to 7% for corporations.  The increased tax rates apply to income earned on and after July 1, 2017.  Information from the Illinois Department of Revenue concerning the new income tax rates, including changes to withholding can be found here.

  Legislative Update: Senate Bill 1687 - IADA Supports - Please Urge Governor Rauner to Sign  
  Senate Bill 1687, which provides for several important updates to the Illinois Vehicle Franchise Act that are needed to assist in balancing the power between the auto manufacturer and the franchised dealer, has recently been delivered to Governor Rauner's desk.. Senate Bill 1687 makes the following changes:
 
  • Exports/Chargebacks.  Prohibits manufacturers from taking back sales incentives paid to dealers if the customer exports the vehicle out of the country, unless the manufacturer can prove that the dealer knew or should have known that the vehicle would be exported.
  • Facility Upgrades.  Prohibits manufacturers from requiring a dealer to remodel his or her facilities within 10 years of the most recently required remodel.  
  • Vendor Choice/Signage.   Prohibits a manufacturer from requiring a dealer to purchase building improvement materials from a manufacturer-designated vendor, provided the dealer can find a vendor can provide substantially similar materials at a lower cost.  Permits a manufacturer to require a specific vendor if the manufacturer reimburses the dealer for the increased cost of the materials.   Also, requires a manufacturer that leases signage and other image and design elements to dealers to give the dealer the option to purchase similar items from a vendor selected by the dealer.   Requires the dealer to conform to the manufacturer's intellectual property usage guidelines.
  • Right of 1st Refusal.  Provides that, when a dealer puts his or her franchise up for sale, a manufacturer cannot exercise its right of 1st refusal to acquire a dealer's franchise, unless the manufacturer:
    • Notifies the dealer, within 60 days after receiving notice of the proposed transfer, that the manufacturer intends to exercise its right of 1st refusal;
    • Pays the dealer at least the same consideration as under the proposed transfer, including the purchase or lease of the dealership's real property;
    • Reimburses the proposed transferee for reasonable expenses incurred in its attempt to acquire the dealership before the manufacturer exercised its right of 1st refusal.
  • Sales Performance.  Requires manufacturers, when evaluating a dealer's sales performance as part of the termination process, to consider local factors in the dealer's market area.

  2018 Time Quality Dealer of the Year Award  
  IADA is looking for nominations for the 2018 Time Quality Dealer of the Year Award.

To be considered for selection, a nominee must:
  • Be a franchised new-car/truck dealer; 
  • Be a member of NADA; 
  • Be a member of a state dealer association; 
  • Be the operating head of the dealership as designated in the franchise paragraph of the factory agreement for a minimum of one year;
  • Have a presence in the dealership offices during at least 60% of business hours; 
  • Have at least a five-year record of active participation in affairs of the nominee's state or local dealer association; and 
  • Agree to be available for participation in Dealer of the Year activities at NADA's 2018 Convention in Las Vegas.
Nominations can be submitted here, and need to be completed by Friday, July 14th. They will be reviewed, and dealers from Illinois will be chosen by IADA's Nominating Committee. Please provide as much detail as possible. Thank you for your involvement in recognizing a deserving Illinois dealer.
