Illinois Legislature Enters Final Week of Session
|
|
|
The Illinois Legislature is in the final week of the spring session and the legislative leaders and governor continued to meet on the budget this week. Still much remains to get a budget in place however, it appears that discussions are going better than previous budget negotiations.
Sen. Oberweis' legislation to repeal the Sunday Closing Law is dead for this session. IADA was able to keep the bill in committee and no committee hearing was scheduled this year!

Trump Signs Resolution Blocking CFPB Auto Lending Guidance
|

|
President Donald Trump signed S.J. Res. 57 disapproving the Consumer Financial Protection Bureau's 2013 flawed auto lending guidance that sought to pressure lenders to impose flat fees or no compensation for dealers to arrange loans. The guidance could have also prevented dealers from discounting fees for legitimate business reasons.
The resolution passed the U.S. House of Representatives by a more comfortable margin with almost unanimous Republican support and some limited help from Democrats, unfortunately none of our Illinois democrats voted for the measure and Congressman Bill Foster spoke against the measure on the House floor.
The Congressional Review Act resolution was the first to block an agency guidance. Under federal law, the CFPB's guidance is now nullified and the agency is barred from issuing a new guidance that is "substantially the same" without prior Congressional approval. Interestingly, Acting CFPB Director Mick Mulvaney, a Trump appointee, said "I thank the President and the Congress for reaffirming that the Bureau lacks the power to act outside of federal statutes. As an executive agency, we are bound to enforce the law as written, not as we may wish it to be. In this case, the initiative that the previous leadership of the Bureau pursued seemed like a solution in search of a problem."
This is a great victory for NADA and for all the dealers and state and local associations that took the time to contact their Members of Congress urging them to block this misguided guidance. Special recognition goes to NADA and the entire NADA legislative team, for this impressive victory.

Supreme Court Upholds Class Waiver In Employment Arbitration Agreements

|
Settling what has been a controversial issue for years, the U.S. Supreme Court recently upheld by a 5-4 vote the right of a business to include a class waiver in its employee arbitration agreements.
That means that employees who sign such an agreement may not participate as a group or class when legally challenging their employer. It must be done individually. Dealers who choose to use arbitration in employee agreements or in sales and lease transactions with their customers should periodically have their lawyers review the agreements to ensure they are up to date. |

President Trump Considers Import Vehicle Tariffs
|

This week the President surprised the auto industry indicating he is considering imposing tariffs on vehicle imports, trucks and parts if it is determined a national security threat exists. The proposal is expected to receive resistance in Congress and has already seen many organizations, business groups and manufacturers voicing concerns and calling for opposition to this proposal. |

Takata Airbags Recall Continues To Expand
|

|
This information is provided by KPA an endorsed provider of the IADA. The Takata airbag recall has been going since May 16, 2016. It now involves 19 vehicle manufacturers, 46 million Takata airbag inflators, and 34 million vehicles in the U.S. The U.S. Department of Transportation's National Highway Traffic Safety Administration (NHTSA) has extended the recall to continue through December 2019.
Things to Remember:
- Use NHTSA's Recalls Look-up Tool to see which vehicle makes and models' airbag inflators are currently under recall.
- Refer to NHTSA Coordinated Remedy Order for help prioritizing which vehicles should have their inflators replaced as soon as possible. Generally, the older the vehicle, the more urgent the repair is.
- Ensure that your technicians are following the vehicle manufacturer's instructions when removing, replacing, and handling the defective inflators to reduce the risk of injuries.
- When your business is eligible for reimbursement, including hazmat and shipping fees.
The removed inflators are considered hazardous, carry the risk of exploding, and need to be properly packaged for shipment back to Takata. Ensure all employees involved in the shipping process, including those who remove the airbags, package them and complete shipping paperwork, have completed DOT Hazardous Materials Shipping training. This training is available through myKPAonline.
