  Secretary of State Needs Help to Stamp Out Curbstoning--

As you most likely know by now, the Secretary of State's Office now requires dealers and auctioneers who sell vehicles to out-of-state dealers and out-of-state wholesalers to place a stamp on the front and back of the certificate of title for certain transactions (SOS Notice, click here). The stamp must be in at least 36-point font and say one of the following:

NOT FOR RESALE WITHIN ILLINOIS or NOT FOR RETAIL SALE WITHIN ILLINOIS.

Please note that a vehicle with a title bearing either of those stamps can be sold back to an Illinois customer, but the seller must first title the vehicle in its own name and use that title to transfer the vehicle to an Illinois customer.

A dealership that sells a vehicle directly to an out-of-state dealer or wholesaler must stamp the title if all of the following are true: 
  • The vehicle sells for less than $5,000;
  • The vehicle weighs less than 12,000 pounds; AND
  • The vehicle is on an ILLINOIS Certificate of Title.
  • A dealership that sells a vehicle that meets all of the above conditions through an Illinois auction is not responsible to stamp the title unless the dealer delivers the title directly to the out-of-state buyer.  If the dealer transmits the title to the auction to forward to the buyer, then the auction is responsible to stamp the title.  
Please NO NOT stamp the title if any one of the following is true: 
  • The vehicle sells for $5,000 or more;
  • The vehicle weighs 12,000 pounds or more;
  • The vehicle is on a Certificate of Origin;
  • The vehicle is on a non-Illinois title; OR
  • The vehicle is sold through an out-of-state auction.
