Call to Action: Help Repeal $10,000 Cap on Trade-In Allowance
|

Since early September, IADA and our partners have been promoting our grass roots advocacy campaign to pass legislation that would repeal the $10,000 cap on motor vehicle trade-in credits before it takes effect on January 1, 2020. IADA has provided a very easy way to participate in the legislative process by contacting your State legislators and the Governor about this issue through this IADA Advocacy Campaign link. To date, over 850 IADA members, employees, and other supporters have delivered almost 3,200 messages to State legislators and the Governor! We extend a sincere thank you to those of you who have contacted your legislators and the Governor. The Fall Veto Session will start in less than 2 weeks, so if you have not already contacted your State legislators, please click on the link below to go to our campaign, where we've provided an email message and a very quick way to send it to your respective legislators and the Governor. Legal Update: Clarification on SOS Guidance on TRPs

|
IADA staff met with the Secretary of State's Office to discuss the most recent SOS memo regarding Temporary Registration Permit (TRP) usage (click here). The purpose of the SOS memo was to ensure that, when a dealer issues a TRP, the dealer must also complete a title and registration application at the same time. The SOS memo created confusion for dealers who issue TRPs while waiting to find out whether the customer's application for financing will be approved (instead of spot delivering a vehicle on a dealer plate). SOS clarified that dealers have up to 15 days after issuing a TRP to void the application. If not voided within 15 days, the application will be processed and the vehicle will be titled in the customer's name. If asked to provide an explanation for why the TRP was voided on a cancelled spot delivery, it is recommended that the dealership states simply that the customer elected to cancel the purchase and return the vehicle. |

Legal Update: Federal Odometer Disclosure Changes

|
The National Highway Traffic Safety Administration has adopted amendments to its Odometer Disclosure Requirements, which will take effect starting December 31, 2019. Under the existing rule, vehicles that are at least 10 model years old are exempt from odometer mileage disclosure. Vehicles manufactured during or after the 2010 model year and transferred on or after December 31st, 2019, will not become exempt from odometer mileage disclosure until they are at least 20 model years old. Also starting with transfers made on or after December 31, 2019, dealers will be required to retain odometer disclosures for 5 years after the date of transfer. Regulatory Alert: Illinois Department of Revenue Amnesty Program is Underway
|

The Illinois Department of Revenue is offering a Tax Delinquency Amnesty Program for Illinois taxpayers with outstanding State tax liabilities for most taxes paid to the Department of Revenue. The Amnesty Program covers periods after June 30, 2011 and before July 1, 2018. For taxpayers who pay their eligible tax liabilities by November 15, 2019, the Department of Revenue will waive the penalties and interest associated with those tax liabilities. The Amnesty Program is available to taxpayers who self-report, to taxpayers who are under audit, and to taxpayers who have cases pending with the Department's Board of Appeals, Administrative Hearings Division, or Independent Tax Tribunal. If you have an outstanding tax liability related to taxes collected by the Illinois Department of Revenue or if you have unfiled ST-556 returns for zero tax transactions (dealer trades, exempt purchasers, etc.), you can file by November 15th and avoid penalties and interest charges.
