  IADA Files Bill to Repeal $10,000 Trade-in Cap  
  Senator Tony Muñoz (D - Chicago) and Senator Sue Rezin (R - Morris) have filed Senate Bill 2481, click here, which would restore the full value of the motor vehicle trade-in credit.  Senate Bill 2481 currently has bipartisan support from 8 co-sponsors (click link above to see the full sponsor list) and is expected to be heard in the Senate Revenue Committee next week.

  Illinois Department of Revenue Clarifies Guidance On $10,000 Trade-In Cap  
  The Illinois Department of Revenue revised its Frequently Asked Questions bulletin on the $10,000 motor vehicle trade-in credit cap. The Department's new bulletin provides guidance explaining that the $10,000 cap does apply to vehicle sales to customers who reside in non-reciprocal states. In other words, if you sell a vehicle to a Michigan resident, you must consider the $10,000 cap when determining the taxable selling price, but adjust the tax rate to Michigan's 6% rate. The Department's revised guidance can be found here.

  Pair of Bills Filed to Open Car Sales on Sundays  
  Senator Jim Oberweis (R - Sugar Grove) is expected to request a deadline extension for legislation he filed last year to repeal the Sunday closing law.  This would be Senator Oberweis' 7th year in a row of trying to force dealers to open on Sundays. Senate Bill 22, click here, also known as the "Freedom to Choose Act", would allow dealerships to be open on any six days of the week of their choice, including Sunday. This is another back-handed attempt by Senator Oberweis to allow vehicle sales on Sundays. His focus is that if one dealership opens on Sundays, many others will follow. As always, IADA will attempt to defeat his legislation in committee. This sponsor is very driven the past few years to open dealerships on Sundays.

In the House Chamber, Representative Yehiel "Mark" Kalish (D - Skokie) filed House Bill 4212, click here. which would eliminate the ban on Sunday vehicle sales.  If the Sunday closing law gets repealed, dealers will have little choice to being open every day of the week, which hurts employee morale and increases dealership operating costs without increasing sales. 

IADA will update membership if either of these bills get posted for a committee hearing.  We will also have a more extensive report of all legislation affecting dealerships after the bill filing deadline passes.

  Dealerships Must Use New Employment Eligibility Verification Form I-9  
  Effective January 31, 2020, employers verifying the identity of new hires or re-verifying the employment authorization of existing employees should use the October 21, 2019, version of the Employment Eligibility Verification (I-9) Form issued by the Department of Homeland Security's United States Customs and Immigration Service (USCIS). 
The revised Form I-9 and related instructions address and provide clarification on: 
  • Countries with recent name changes
  • Representatives authorized to act on behalf of employers
  • USCIS website addresses
  • Acceptable employment eligibility support documents
  • The process for accessing and using a paper USCIS Form I-9
  • The DHS Privacy Notice 
Dealerships must keep completed I-9s on file for potential inspection by federal agency and law enforcement authorities. The prior version of USCIS Form I-9 (Rev. 07/17/2017 N) may be used until April 30, 2020, after which only the new (Rev. 10/21/19) version may be used. Note that the version date is found in the lower left corner of the form.

  After having his employment terminated for performance issues, a salesman sued his former employer for retaliatory discharge.
