  IADA THANKS DAVID GUEBERT  
 
On behalf of the IADA Board of Directors, Staff and Membership, we offer our congratulations to David Guebert, Sparta Ford-Mercury, Sparta, Illinois, for his outstanding service and leadership to IADA during his term as Chairman in 2009. David will be recognized during the IADA Annual Spring Conference to be held in MarcoIsland, March 27-31, 2010, at the Marriott Marco Island Resort & Spa.

  SECRETARY OF STATE JESSE WHITE NOTIFICATION  
 
IADA is working in conjunction with the Illinois Secretary of State’s office and law enforcement agencies with regard to defective license plates. It has been brought to our attention that there have been a number of plates in which the protective coating has worn prematurely.
 
With this being the case, it makes it difficult for law enforcement agencies to be able to identify license plates. The Secretary of State and law enforcement agencies have asked for franchised dealers’ assistance in having customers contact their offices for replacement plates.
 
During the course of business, if a dealer determines that an individual has one or more defective plates, where air pockets are forming around the digits or the clear protective coating is peeling, please encourage your customer to contact SOS offices for replacement plates.
 
The Secretary of State will replace them free of charge. A new set of license plates will be ordered reflecting the same license plate number(s) and mailed to your customer in approximately 45 days from the receipt of the defective license plate contact form. A registration sticker will be sent with the new license plates, provided that the license plates’ registration is current.
 
Your customer can fill out the form which can be obtained at the Secretary of State’s website, which is cyberdriveillinois.com or call the Vehicle Services Department at 1-800-252-8980.
 
IADA would like to recognize and thank Secretary of State Jesse White for his assistance with franchised dealers during these tough economic times. The Secretary’s office has been very supportive of our legislative and legal efforts regarding franchise issues and dealer issues in general. Their legal offices have also filed procedural legal action supporting the Illinois Motor Vehicle Franchise Act.
 
The Secretary appreciates our assistance in working with customers to identify defective license plates.

  DEALER ARBITRATION-DOCUMENT REQUESTS  
 
In at least some of their initial Requests for the Production of Documents, attorneys for General Motors are seeking “copies of any customer complaints received by the dealership or any communications with any state, federal, or other consumer protection agency since January 1, 2006”.
 
If you need to obtain copies of a consumer complaint that was filed with the Illinois Attorney General’s Office, you can submit a Freedom of Information Act (FOIA) request to the Attorney General’s Springfield office in writing, by fax, or by e-mail. Information about filing FIOA requests with the Illinois Attorney General can be found at: http://foia.ilattorneygeneral.net/howtofile_foiarequest1_new.aspx.
 
If you need to obtain copies of a consumer complaint that was filed with the Better Business Bureau, you can find information about the office that is closest to you at: http://chicago.bbb.org/find-a-bbb/.

  LEGISLATIVE UPDATE  
 
While it was a fairly quite week in the Illinois Legislature IADA testified in support of HB 4796 – which changes the length of time a vehicle can operate on a drive-away-decal from 7 days to 30 days. The Illinois Secretary of State’s office had earlier agreed to these changes however a legislative change is needed to implement.
 
IADA was also successful in convincing the sponsor of SB 3548 – which made numerous changes to the Illinois New Car Buyer Protection Act (Lemon Law) not to call the legislation for a committee hearing.
 
Another bill (HB 5531) also amends the New Car Buyer Protection Act (Lemon Law) and would eliminate “As-Is” sales and mandates written warranties for all vehicles. We are continuing to work on this legislation and as of this date it has not been called for a legislative committee hearing.
 
As we continue to make progress on these bills and other legislation we will keep you advised if legislative contacts are needed!
