For years, NFIB has actively fought for small business owner rights against expanding federal authority over private property, specifically the expansion of the Clean Water Act that would require federal permits for lands that are dry most of the year.
Recently, the EPA finalized a rule establishing the new definition of Waters of the United States (WOTUS). This ruling was made despite the fact that the Supreme Court will be hearing Sackett. v. Environmental Protection Agency, a case that will decide the definition of the WOTUS Rule. The NFIB Small Business Legal Center has filed a brief in the case to highlight the impact of the WOTUS Rule on small business. NFIB is looking for anecdotes specifically detailing situations of regulation, imposition of costs, and criminal penalties.
