MAGNUSON-MOSS
Several days ago, we sent our members an action alert to notify your legislators to vote yes on S-1712. Thank you to those of you who contacted your legislators. The issue is our effort to require car manufacturers to mail a notice to every new car purchaser and notify them of their rights under the Magnuson-Moss Act. This act clearly states that motorists are permitted to bring their car into your shops without voiding their warranty. Too many motorists are under the impression that while their car is covered by a warranty they must bring it to the dealer. Sadly, many shop owners also believe the same thing. At the time that I am writing this, the vote has not taken place. I will know by close of business today if it passed in the Senate. The lobbyists for all of the car manufacturers have been out in force twisting the arms of legislators to vote against us on this bill. 
 
MARKETPLACE
Although I do not discuss the fuel marketplace as often as I used to, I must say that I have observed for the past few months with some exceptions that most of you have been working off some pretty healthy profit margins. Yes, I still see a few jerks who obviously can't add and subtract or are too stupid to realize that more gallons actually means less profits. Overall from what I can tell, 2019 has been a decent year from a margin point of view. I continue to encourage you to expand your profit margins and stop worrying about gallons. Let the moron down the street thump his chest because he sells more gallons than you, but quietly at the end of the day you'll have more money in your bank account. 
 
MBP SURVEY
Once again, I thank those of you who have taken the effort to complete the 2019 MBP survey that we have emailed to you. For those of you who have not done so yet, I am asking that you take a few minutes to please do this. You can click here right now and help us out. All of you know how hard we work to determine who we invite to participate in our Member Benefit Program. It is important for us to get your point of view about those participants that are listed in our brochure. In each of the categories, if you have another vendor or service provider other than an endorsed NJGCA MBP, please complete that section with the name of your vendor and let us know if we should consider that vendor for inclusion in our program. By the same token, if you have a vendor or provider that you use that you would not recommend, please let us know that too. 
 
ETEP
For any emission repair technician whose license expired either in June or December of 2019, this will be the last time you can take the emission technician education program (ETEP) courses. As of January 1st 2020, any emission repair technician (ERT) will have to renew their ERT licenses through ASE only, no other option will be available. If your license expired in June or December of 2019, NJGCA has the classes you need held in December of this year. This is the last time NJGCA or any other ETEP training provider can offer these classes. We also offer discounted rates for NJGCA members. If you want to certify a brand new technician into the emission repair technician status and if you want to use the ETEP program, we have the entire program being offered November through December. We are also offering the recertification program for those of you with expiring licenses. Limited seats are available, we suggest registering now, the class is already filling up quickly.

Want your technicians to become a NJ Emissions Inspector? We can help! Our new two-day class will provide all the information for becoming a NJ Emissions Inspector. Day one will consist of written test training and the State will administer the written test the very same day at our offices. Day two will be a hands-on training course to prepare you for the hands-on test. Class will run from 7:00am to 4:00pm on day 1. Class will begin at 12:30 PM on day 2. Cost is $479 for members.

Stop turning away work!

The New Jersey Inspection Program requires vehicles that fail emissions inspection to go to a Licensed Certified Emission Repair Facility and have a Licensed Emission Repair Technician perform the repairs! When the new Emissions Inspection program begins, a list of Certified Emission Repair Facilities will be given to the vehicle owners who fail the New Jersey Emission Inspection. If you want your business name on the list - make sure you have a Certified Licensed Emission Repair Technician and you are licensed as a Emission Repair Facility! Those signing up for the FULL training course will attend sections 1-10. Full ETEP class fees for members are $2,195 and non-members are $2,395. Recertification fees for members are $729 and non-members are $879. This is the last class for the entire program, register early!

U.S. Will Move to Ban Flavored E-Cigarettes, Trump Official Says
President Donald Trump called vaping a "problem" and his health secretary said the government would force companies to remove flavored vaping products from the market after reports of hundreds of U.S. cases of a mysterious illness related to e-cigarette devices. . .Azar said the FDA would soon issue regulatory guidance allowing the agency to remove flavored vaping products that are believed to appeal to children. Five million children are using e-cigarette products, Azar said, calling it an "alarming" trend. More than 450 cases of the respiratory condition were reported as of Sept. 6, according to the Centers for Disease Control and Prevention. The severity of the cases vary, but six people have died.

You'd Pay Full Price To Light Up As N.J. Eyes Banning Coupons, Discounts For Cigarettes
A state Senate committee on Tuesday approved legislation banning any coupons, online discount codes and rebates for tobacco and vaping products. Retailers would face fines of up to $1,000 per offense if they offered coupons, price reductions and rebates on tobacco and vaping products, according to the bill. And retailers that violate the ban could have their license revoked. While no one testified before the Senate Health, Human Services and Senior Citizens Committee, the New Jersey Food Council, NJ Gasoline-Convenience-Automotive Association and the New Jersey Retail Merchants Association and lodged their opposition to the bill (S3181).

N.J. Could Ban Vaping Completely, Powerful Democrat Says
New Jersey's most powerful state lawmaker said he's considering proposing a "full ban" on vaping in the Garden State as concern continues to swirl over whether the practice is harmful to your health. "I'm starting to think the more and more we find out about vaping, maybe we should ban vaping altogether," state Senate President Stephen Sweeney, D-Gloucester, told NJ Advance Media on Tuesday. Sweeney - New Jersey's highest-ranking state lawmaker - said he hasn't yet drafted legislation, nor has it become a full discussion in the state Legislature. But, he said, he's "seriously looking into" the idea.

Cigarette Sales Could Soon Be Banned In Pharmacies And Some Supermarkets In N.J.
New Jersey could soon bar pharmacies - as well as supermarkets and other retailers with pharmacies on their premises - from selling tobacco products. CVS Health voluntarily stopped selling cigarettes in its stores nationwide five years ago and Target quit selling them in the 1990s. And a bill (S992) under consideration in the state Legislature would impose a ban on all pharmacies operating in the state.
