In 2020, the New York Legislature passed a law to end the sale of flavored e-cigarettes. But compliance has been terrible. This means candy-flavored e-cigarettes are still widely available statewide and are still being sold to our kids, fueling the youth nicotine addiction crisis.
This is happening because there are enforcement loopholes in the law, such as:
Right now, there's a bill before the Legislature that would fix this (S.5196 / A.2128). It would close the loopholes and strengthen local health departments' ability to stop stores from selling illegal e-cigarettes. We need legislators to make this a priority and pass the legislation before they adjourn for the summer.
