The New York State Senate and Assembly have once again passed a bill (S4423/A6063) that would dramatically increase damages awardable in wrongful death actions, and produce a staggering increase in liability premiums. The Governor has vetoed similar bills, citing that the legislation would have “the potential for significant unintended consequences” and “… risk financial well-being of our health care facilities.” The same concerns exist with the new version of the legislation.
Therefore, we are asking NYSSPS members to contact the Governor to vote no to this one-sided legislation and urge comprehensive and balanced medical malpractice reform.
