SB 426-A places an undue burden on homeowners, making them liable when a subcontractor fails to pay its workers, even if the homeowner has fully paid their general contractor and has no relationship with the subcontractor. This is fundamentally unfair. This bill passed the Senate and was initially presented in the House with the promise that most homeowners were exempt from liability, a claim that has since proven to be incorrect.
Despite clear evidence from stakeholders in the recent hearing that homeowners would remain liable, some legislators are pressing forward without addressing this critical issue. We cannot allow this bill to pass without recognizing its true implications.
