    Bill Summary

    This bill revises various provisions governing the state textbook commission.

    COMMISSION MEMBERS
    This bill revises the way members of the state textbook commission are chosen.

    PRESENT LAW
    Under present law, the commission is composed of 10 members, nine of whom are appointed by the governor. The following is required in regard to the members:

    (1) Six of the members of the commission must be educators of high qualifications who are actually engaged in educational work in the state, and whose educational qualifications must not be less than graduation from a four-year college with a bachelor's degree, and with at least five years of teaching, supervisory or administrative experience;
    (2) One of the members must be a county director of schools, one a city director of schools, one a school principal, one a teacher or supervisor in the lower grades, grades one to three, inclusive, one a teacher or supervisor in the intermediate grades, grades four to eight, inclusive, and one member must be a teacher or supervisor of upper grade subjects, grades nine to 12, inclusive;
    (3) Three of the members of the commission must be citizens of this state who are not employed in the educational system of this state but who are knowledgeable about the condition of education in this state. These three members must reside in different grand divisions;
    (4) The commissioner of education serves, ex officio; and
    (5) At least two members must be appointed from each grand division of the state.


    THIS BILL
    Under this bill, the commission will still consist of 10 members, but the speakers of the senate and house, in addition to the governor, will be responsible for making appointments, and the general assembly must confirm the appointments. The following will apply to appointments under this bill (some of which is like the present law provisions):

    (1) The governor, the speaker of the senate, and the speaker of the house will each appoint one member from each grand division of the state and the commissioner will be an ex officio secretary of the commission with the right to vote;
    (2) Of those nine appointed, one member must be chosen from each of the following groups: county directors of schools, city directors of schools, school principals, teachers from grades k-3, teachers from grades 4-8, teachers from grades 9-12;
    (3) The three remaining members must be citizens of the state who are not employed by the educational system, but are knowledgeable of education issues.

    This bill requires the appointing authorities to consult with each other prior to appointing any member to ensure that appointments are made in accordance with these requirements.

    Under this bill, an appointee must be confirmed by joint resolution of the general assembly upon the recommendation of education committees. If the general assembly is not in session when a member's term expires, that member will continue to serve until a new appointee can be confirmed. If there is a vacancy for a reason other than the expiration of a term when the general assembly is not in session, then the new appointee will serve for the term appointed unless not confirmed within 60 days after the general assembly next convenes. If the general assembly is not is session when the initial appointments are made then the appointee will serve their term unless such appointment is not confirmed within 60 days after the general assembly next convenes.

    This bill will vacate the entire membership of the existing commission on January 1, 2015, and new appointments will be made. Commission terms will be for three years, but in order to stagger the terms of the new members, the initial appointments will be made as follows:

    (1) Each of the three appointing authorities will make on initial appointment for a term of one year;
    (2) Each of the three appointing authorities will make an initial appointment for a term of two years; and
    (3) Each of the three appointing authorities will make an initial appointment for a term of three years.

    This bill provides that commission members may only serve two consecutive three-year terms.


    AUTHORITY AND DUTIES OF THE COMMISSION

    This bill requires the department of education to provide mandatory training to new members of the commission on their assigned tasks, including but not limited to:

    (1) The delivery of quality textbook programs to LEAs;
    (2) The adoption of physical standards and specifications that assure suitable durability of textbooks;
    (3) The review of programs bid against the curriculum standards approved by the board of education;
    (4) The establishment of contracts that guarantee availability of adopted programs to all LEAs at the lowest price;
    (5) The authority, responsibility, and duties of the commission including a review of the statutes and rules that govern the commission;
    (6) The time frame for the textbook review process;
    (7) The goals of the textbook review process;
    (8) The First Amendment to the U.S. Constitution; and
    (9) The goals of the review process (discussed below).

    This bill provides that no textbook may be approved unless the book:

    (1) Conforms to the standards for its subject area or grade level;
    (2) Is free of any clear, substantive, factual or grammatical error;
    (3) Is free from any biases in its viewpoints; and
    (4) Reflects the values of the citizens of this state as manifested in the United States Constitution, the Constitution of Tennessee and other foundational documents of this nation's republican form of government.

    Present law prohibits a member of the commission from:

    (1) Receiving any gift, reward present or emolument from any author, publisher or distributor of a book, except copies of books offered for listing and adoption; or
    (2) Accepting employment as agent, attorney, subagent, employee or representative of any author publisher or distributor of textbooks during the member's term of service, nor within 12 months after the end of the member's term.

    This bill adds that a knowing violation of either of the above provisions may subject the commission member to criminal prosecution (SEE NOTE).

    This bill requires the commission to evaluate all reviews submitted by members of the advisory panel (discussed below). This bill also provides for the calling of a public hearing if the reviews by the advisory panel do not lead to a clear recommendation as to the approval or rejection of a specific textbook or if the commission finds that public comments indicate that further review is called for. This bill requires the department to develop the procedure by which members of the public may comment on books proposed for adoption.

    ADVISORY PANELS

    Under present law, the commission may appoint an advisory panel of expert teachers in each subject area or grade level to advise the commission on book selections. This bill allows for the appointment of experts other than teachers. This bill requires that at least one teacher be appointed to each panel, and that those teachers have a license and an endorsement in the subject or grade for which they are advising. Experts who are not teachers may include college professors and credential subject matter specialists.

    This bill requires the department of education to provide mandatory training to members of advisory panels. The training must include:

    (1) The requirements for performing a thorough review of all textbooks assigned to a member. The review must include an examination of the items described above in (1)-(4) regarding textbook approval;
    (2) The use of forms developed by the commission; and
    (3) The time frame for completing their tasks.

    This bill requires that the names of the reviewers, their positions, employers and the panels on which they serve be posted on the department's web site.

    This bill requires the advisory panelist to take into consideration public comments posted on the department's web site regarding a textbook before issuing a recommendation on a textbook to the commission.

    LIST OF TEXTBOOKS FOR APPROVAL

    Present law provides that it is the duty of the commission to prepare a list of standard editions of textbooks for approval by the state board of education for use in the public schools of the state. This bill specifies that, with the approval of the state board, the commission will publish the list of textbooks that may be adopted by local boards of education for use in the schools of this state. The list must contain the title of the textbooks listed for adoption, the names of the publishers and the prices at which the books are available. This bill requires that the proposed textbook list also be posted on the department's web site.

    This bill removes the present law provision that in recommending textbooks for use in economics or business-oriented courses or programs, the commission should include at least one textbook written, illustrated and exemplified in such a manner as to facilitate comprehension by all students, including those of disadvantaged socioeconomic circumstances and of culturally different backgrounds.

    REVIEW COMMITTEES

    Under present law, local boards of education are authorized and required to adopt textbooks to be used in the public schools of their school districts, from the list of textbooks provided for adoption by the commission. Boards must make their adoption upon recommendations of committees. These committees are set up by subject matter fields and composed of teachers, or supervisors and teachers, with the number of members of each committee to be determined by the board based upon the relative size of the local school system. The teachers and supervisors must be teaching or supervising the respective subject at the time of appointment and will be by grade or groups of grades arranged so that a committee may consider an entire series of books if it should so desire; provided, that in all cases, the teachers appointed on the committees must hold professional certificates and have had three or more years of experience as teachers or supervisors in the public schools.

    This bill adds parents with children enrolled in the LEA and experts in the grade level or subject matter field to the individuals available for appointment to the committee. This bill authorizes these appointed individuals to serve for the length of time the adoption process lasts. This bill also allows for other experts to be appointed to the committee.


    OTHER PROVISIONS

    Under present law, each member of the commission receives $15.00 a day for attendance upon all regular and called meetings of the commission and, in addition, they receive necessary traveling expenses.

    This bill requires a publisher submitting a textbook for possible approval to execute an agreement that, among other things, certifies that the book has been thoroughly examined and reviewed by qualified content experts for factual accuracy and agrees to correct all factual and editing errors at the publisher's expense.

    This bill requires that copies of the books be filed with the secretary of the commission no later than the date of the start of review by the advisory panels. Publishers must also make the books available for inspection online by LEAs and the public.

    Under present law, a contracted book publisher must file a bond for the faithful performance of its duties. The bond has to be in an amount set by the commission, but not to exceed $1 million. This bill changes the limit of the bond amount to between $2,000 and $10,000, as determined by the commission.

    Under present law, the textbook commission has a July 1, 2014, sunset date. This bill extends the sunset date to July 1, 2017.

    NOTE: It should be noted that in SECTION 3 of this bill, in 49-6-2201(k)(4), the bill indicates that certain behavior by a commission member "may" make the person subject to criminal prosecution. It is not clear by this language who will be considered to have committed an offense and who will not, and the bill does not indicate the penalty for the criminal offense. Generally under Tennessee law, an unclassified misdemeanor is a Class A misdemeanor and an unclassified felony is a Class E felony. This bill does not indicate whether the person would be charged with a felony or a misdemeanor, if a person is prosecuted.

    ON MARCH 17, 2014, THE SENATE ADOPTED AMENDMENTS #2, #3, AND #1, AND PASSED SENATE BILL 1602, AS AMENDED.

    AMENDMENT #2 specifies that this bill and provisions of present law regarding textbooks apply to "textbooks and instructional materials". This amendment renames the commission to be the state textbook and instructional materials commission.

    AMENDMENT #3 clarifies that when the bill states that a member of the commission may be subject to criminal prosecution, that such prosecution will be pursuant to applicable criminal statutes.

    AMENDMENT #1 makes a technical correction and revises the provision of the bill making the commissioner of education an ex officio secretary of the commission by adding that a deputy commissioner or an assistant commissioner of education serving as the commissioner's designee may fill the role of ex officio secretary.

    ON APRIL 16, 2014, THE HOUSE SUBSTITUTED SENATE BILL 1602 FOR HOUSE BILL 2249, ADOPTED AMENDMENTS #1, #2, AND #3 AND PASSED SENATE BILL 1602, AS AMENDED.

    AMENDMENT #1 revises the provisions regarding the makeup of the commission to be as follows:

    (1) The speaker of the senate will appoint two members;
    (2) The speaker of the house of representatives will appoint two members; and
    (3) The governor will appoint five members.

    Accordingly, the amendment also revises the staggered-term provisions. This amendment specifies that there must be three appointed members from each grand division of the state. This amendment removes the provision whereby a deputy commissioner or assistant commissioner may serve instead of the commissioner of education.

    This amendment changes the name of the commission to be "the state textbook and instructional materials quality commission" (SEE NOTE) and removes the reference to textbooks and instructional materials being "free from any biases in their viewpoints".

    NOTE: This amendment refers to the "state textbook commission" instead of the "state textbook and instructional materials quality commission" in SECTION 3, in 49-6-2201(a).

    AMENDMENT #2 removes the provision of the bill requiring that the commission to only recommend textbooks and instructional materials that reflect the values of the citizens of this state as manifested in the United States Constitution, the Constitution of Tennessee and other foundational documents of this nation's republican form of government.

    This amendment specifies that that the commission will only recommend textbooks and instructional materials for United States history and this nation's republican form of government that reflect the values of the three branches of government, the fundamental documents that underpin our form of government, an understanding of how laws are enacted, and ways citizens shape and influence government and governmental actions.

    AMENDMENT #3 corrects a reference to the title of the commission.
