    Bill Summary

    Under present law, the members of the state board of education are appointed by the governor and confirmed by the senate and the house of representatives. One member is appointed from each congressional district, one is a high school student member, and there is one ex officio member. The members are appointed to five-year terms. At least three members must be appointed from both the majority and minority parties, and one appointed member must be of the minority race.

    This bill requires that the members representing the nine congressional districts be elected from those districts. An individual must reside within the district from which the individual seeks election, as the district is apportioned at the time of election. The elected members will serve four-year terms, and may serve no more than one additional term. As the terms of the members now serving expire, the vacancies created in their seats will be filled by appointment of the general assembly. Such person will serve until a successor is elected and qualified according to law. The successor will be elected in the next regular November election for which candidates have a sufficient time to qualify.

    Under this bill, if an elected member moves from the district from which the member was elected, then the member's seat on the board will become vacant and must be filled by appointment by the general assembly. A person so appointed will serve until a successor is elected and qualified. The successor will be elected in the next regular November election for which candidates have a sufficient time to qualify.
