    Bill Summary

    Under present law, the course of instruction in all public schools is urged to include, at some appropriate grade level in high school, courses and content designed to educate children in the United States government. This bill requires, instead of urges, that such education be include in the course of instruction. This bill details the information that must be included in such courses and content regarding the United States government. This bill requires all school district boards of education to document and report to the commissioner of education their compliance with the content of courses as described above. Copies of this documentation must be retained in each school for access by parents and the public at large.

    This bill requires that each student be taught the foundational instruments, mechanisms and values of American government. No teacher or administrator in an LEA may be prohibited from using or reading from the United States constitution during the course of educational instruction, or from posting the United States constitution in a public school building, classroom or event.

    Generally, present law requires the textbook commission to recommend textbooks to the state board of education for use in the public schools of the state. In recommending textbooks for use in social studies, Tennessee history, American history or any related subject, the commission must strive to recommend textbooks that accurately and comprehensively portray the full range of diversity and achievement of racial and ethnic minorities as well as the role and importance of religion in history. This bill rewrites this provision to instead require that the commission, in recommending textbooks for use in such subjects, recommend only textbooks that accurately and comprehensively relate and explain the achievements of United States citizens. The text must describe the factual circumstances of advances in political liberty, economic and technological progress, and the success of the United States as a leader in the age of industry, with emphasis on the political and cultural elements that distinguished America in this era from other nations, past and contemporary. Appropriate commentary would include descriptions of religious, ethnic and cultural values that took America on a different course from other nations.

    ON MARCH 28, 2013, THE SENATE ADOPTED AMENDMENT #1 AND RESET SENATE BILL 1266, AS AMENDED.

    AMENDMENT #1 adds instruction in Tennessee's government and foundational documents to this bill and also requires that such subjects be included in the materials as described in the bill summary.

    ON JANUARY 14, 2014, THE SENATE FURTHER CONSIDERED SENATE BILL 1266, ADOPTED AMENDMENT #2, AND PASSED SENATE BILL 1266, AS AMENDED.

    AMENDMENT #2 changes the bill's effective date to July 1, 2014.

    ON MARCH 13, 2014, THE HOUSE SUBSTITUTED SENATE BILL 1266 FOR HOUSE BILL 1129, ADOPTED AMENDMENTS #1, 2, 5, AND 7 AND PASSED SENATE BILL 1266, AS AMENDED.

    AMENDMENT #1 specifies that each student must be taught the documents, writings or records set out in present law, as amended by this bill, which are:

    (1) The national motto;
    (2) The national anthem;
    (3) The Pledge of Allegiance;
    (4) The Constitution of Tennessee;
    (5) The Declaration of Independence;
    (6) The writings, speeches, documents and proclamations of the founders or presidents of the United States or the founders or governors of this state;
    (7) Opinions of the United States and Tennessee supreme courts;
    (8) Acts of the United States congress and acts of the Tennessee general assembly; and
    (9) The United States Constitution (added by this bill).

    This amendment revises this bill's provisions regarding the course of instruction in regard to instruction in the United States government to instead provide that the state board of education must include in the social studies curriculum standards, at the appropriate grade level or levels in high school, as determined by the state board of education through curriculum standards and the local board of education through curriculum, courses and content designed to educate children about the United States and Tennessee governments. The curriculum standards must include the three branches of government, the fundamental documents identified above, an understanding of how laws are enacted, and ways citizens shape and influence government and governmental actions. This amendment specifies that students must be taught about the formation of the governments of the United States and Tennessee using federal and state foundational documents. They must also be taught the significance and relevance of those federal and state foundational documents today. This amendment details other items the instruction must include in regard to the Declaration of Independence, the United States Constitution and the Constitution of Tennessee.

    This amendment rewrites the compliance provisions to require the department of education to report on the implementation in the department's annual report.

    This amendment removes this bill's provisions regarding textbooks.

    AMENDMENT #2 revises the compliance provisions to require the state board of education to submit a report to the members of the general assembly concerning implementation of this bill by August 1, 2014, and each year thereafter. The report may be sent to the members electronically or in an existing annual report.

    AMENDMENT #5 requires the board and the department to postpone any further implementation of Common Core Standards until July 1, 2016.

    AMENDMENT #7 requires the state board and department of education to postpone any further implementation of PARCC assessments until July 1, 2016.
