Education - As enacted, requires that LEAs make all teaching materials, including handouts readily available for review upon request by the parents or legal guardians and that the official operating policies of boards of education must provide that a parent or legal guardian is entitled to review tests that are developed by and graded by a teacher of the parent or legal guardian's child; revises other provisions relative to parental inspection of school materials. - Amends TCA Title 49, Chapter 2 and Title 49, Chapter 6, Part 70.

    ON APRIL 10, 2014, THE SENATE ADOPTED AMENDMENTS #1 AND #2 AND PASSED SENATE BILL 2559, AS AMENDED.

    AMENDMENT #1 revises this bill's requirements that:

    (1) LEAs must make all teaching materials, including handouts and tests readily available for review by parents or legal guardians and that the LEAs must specify reasonable hours for review; and
    (2) The official operating policies of boards of education must provide that a parent or legal guardian is entitled to review each test administered to the parent or legal guardian's child after the test is administered.

    This amendment instead requires that:

    (1) LEAs must make all teaching materials, including handouts readily available for review upon request by the parents or legal guardians; and
    (2) The official operating policies of boards of education must provide that a parent or legal guardian is entitled to review tests that are developed by and graded by a teacher of the parent or legal guardian's child.

    This amendment deletes the provision of this bill that entitles a student's parent or legal guardian to request that the LEA allow the student to take home any textbooks or instructional materials used by the student. This amendment also removes the corresponding requirement that a student who takes home instructional materials must return the instructional materials to school at the beginning of the next school day if requested to do so by the student's teacher. Similar requirements to the two deleted provisions already exist in present law, which requires that every student must be permitted to take any textbook specifically issued to the student home for the purpose of studying the textbook and that a school or teacher may require a student to return the textbook to the classroom during school hours.

    This amendment adds a requirement to this bill that LEAs must disclose to the parent or legal guardian of a student the purpose for the survey, analysis, or evaluation materials as well as who will have access to the results.

    This amendment adds to the present law concerning students being able to take textbooks home for study purposes by also specifying that textbooks may be taken home for study or review purposes.

    NOTE: Section 3 of this amendment amends a section of present law that is outside the caption of this bill.

    AMENDMENT #2 removes section 3 of Senate Amendment #1 that would have added to the present law concerning students being able to take textbooks home for study purposes by also specifying that textbooks may be taken home for study or review purposes.

    This amendment adds that, notwithstanding this bill's requirement that LEAs must allow parents and legal guardians of students access to review all surveys, analyses or evaluations, prior to being administered to the parent or legal guardian's child, LEAs must require a parent, legal guardian or student, in the case of students 18 years of age or older, to provide written consent before the collection of individual student biometric data.

    This amendment adds a requirement to this bill that LEAs must disclose to the parent or legal guardian of a student the purpose for the survey, analysis, or evaluation materials as well as who will have access to the results.
