Despite Congress passing the No Surprises Act to protect patients, many insurance companies continue to ignore the law by delaying payments, refusing to comply with dispute resolution decisions, and exploiting loopholes that threaten emergency physician practices and patient access to care. Congress has an opportunity to fix these enforcement failures—but lawmakers need to hear from emergency physicians now.
Why Now
Congress is taking a hard look at health care affordability, and the role insurers play in driving costs and limiting access to care. ACEP has been at the center of that conversation, recently providing a statement for House Energy and Commerce and Ways and Means hearings that examined the affordability of health care insurance and the role of large insurance companies in growing costs and rising premiums. We documented how insurance companies continue to undermine the No Surprises Act as well as other abusive payment practices that threaten emergency physician practices and patient access to emergency care.
Now we must build on that momentum.
We need your help urging your Members of Congress to cosponsor the bipartisan No Surprises Act Enforcement Act (H.R. 4710/S. 2420). This legislation strengthens enforcement of the No Surprises Act by holding insurers accountable when they fail to follow the law and by increasing transparency around insurer compliance.
