HR 9830, the Lawful Hemp Protection Act, reflects the increasing consensus that a clear federal framework is needed to support a stable, transparent hemp beverage marketplace. Introduced by
Rep. Andy Barr (R-KY) and co-sponsored by
Rep. Angie Craig (D-MN), the Act allows responsible operators across the supply chain to continue to grow and compete. Key elements include:
- Establishing that hemp drinks can only be marketed and sold to adults aged 21 and over
- Protecting public health through testing requirements
- Empowering consumers by developing clear, strong labeling requirements
- Leveraging the existing alcohol regulatory framework, commonly called the three-tier system
- Creating parity with the alcohol industry by establishing an excise tax
HBA and other stakeholders worked with Representative Barr and Representative Craig’s office over several months to develop this legislation that builds on the accountability standards that have long governed the alcohol marketplace.
