Oppose Oklahoma SB 986 - “Total Price” Advertising Requirement
What Happened

The Oklahoma Legislature has introduced OK SB 986, a bill that would require fitness facilities to prominently feature the “total price” when advertising, displaying, or offering pricing information for goods or services.


Why It Matters

  • Last year, HFA successfully secured an exemption for the fitness industry from the FTC Junk Fee Rule, meaning facilities are not required to advertise a “total price” at the federal level.
  • SB 986 would override this exemption in Oklahoma, contradicting federal rulemaking and creating confusion and compliance challenges for businesses.
  • Fitness facility pricing is dynamic and individualized, including monthly access fees, personal training, spa treatments, specialty classes, and retail items. Requiring a “total price” is impractical and limits pricing flexibility for both businesses and consumers.
