  IBA Member Appointed to Governor's Council  
  Governor Mike Pence has appointed Tom Slater to the Indiana Land Resources Council. Tom will serve a four-year term through September 15, 2020. Tom is Director of Business Development at Timberland Lumber Company and an IBA Life Director, Associate National Director, and Associate Area Vice President. Click here for the full press release.

  Commission on Immigration Issues Hears Testimony  
  The Indiana Senate Select Commission on Immigration Issues, chaired by State Senator Mike Delph (R-Carmel), met earlier this week and took testimony from members of the public as well as researchers from an immigration reform advocacy group on the positive impact immigrant workers have had on the state.  
 
The Commission was an outgrowth of legislation (SB 285) that stalled earlier this year in the Indiana General Assembly. Proponents of SB 285 would like to see businesses that hire undocumented workers lose their license to operate in Indiana.  The Indiana Builders Association has been an active participant in the immigration debate and believes that comprehensive reform of immigration law and policy should be discussed and debated at the federal level.  Immigration reform should protect our borders; provide a process by which immigrants can legally enter the country to work to meet the labor demands of a growing economy; create an enforcement system that is fair, efficient and workable for all U.S. and Indiana employers; place the responsibility of verifying a worker's immigration status with the employer who hires and pays them; and establish a common sense path for foreign workers to earn the right to apply for permanent legal status.
 
The Commission will hold its sixth meeting on November 10th

  Two Recent COA Decisions of Interest to Builders  
  In Bellwether Properties, LLC v. Duke Energy Indiana, LLC, 53A04-1511-CT-1880, Bellwether Properties filed a class-action complaint and jury trial demand in Monroe Circuit Court against Duke Energy on June 30, 2015, after Duke would not allow Bellwether to expand a structure on its property. The Indiana Court of Appeals has reversed a Monroe Circuit Court decision to dismiss a complaint against Duke Energy after finding that the trial court erred when it ruled that the statute of limitations for the complaint had expired. In V. Ganz Builders and Development Co., Inc., and Vladimir Ganz v. Pioneer Lumber, Inc., 64A03-1602-CC-432, the Indiana Court of Appeals reversed summary judgment in favor of construction supplier on its breach of contract claim against a builder to which it provided a line of credit. The appellate court agreed with the defendants' claims that the lawsuit was time-barred. Click here for the story.

  Construction Safety Update: OSHA Injury Reporting Flowchart  
  Since Jan. 1, 2015, OSHA has required employers to report all work-related fatalities within eight hours as well as any inpatient hospitalizations, amputations and losses of an eye within 24 hours. Indiana Builders Association member Greg Gerbers with The DeHayes Group has provided the attached  Injury Reporting Flowchart to help you determine if and when to report an injury to OSHA.

  Indiana's Monthly Employment Report  
 
  • Indiana's unemployment rate of 4.5% is a drop of 0.1% over the month, and ranks 8th in the nation in over the month change. 
  • Indiana's unemployment rate has decreased 6.2% since July 2009 (the low point of employment), which ranks 4th in the U.S.
  • Indiana's unemployment rate decrease of 3.9% since January 2013 ranks 3rd in the nation.
  • The Hoosier labor force has grown by 196,078 individuals since January 2013.
  • Indiana's labor force participation rate has outperformed the national average for 27 months in a row. Indiana's rate is currently 65.5% vs. 62.8% for national.
  • Indiana's labor force has grown by 110,227 over the year and ranks 4th in the nation 
  • Indiana's labor force growth of 3.4% over the year ranks 2rd in the nation.
  • Indiana Private Sector jobs is now 37,100 above the March 2000 peak employment levels.

  Fire Prevention and Building Safety Commission to Meet October 4  
  The Indiana Fire Prevention and Building Safety Commission (Commission) will meet on Tuesday, October 4 at 9:00 a.m. at Indiana Government Center South, Conference Room B in Indianapolis. Click here for meeting materials.
 
The 11-member Commission adopts the code of building and fire safety laws that affect all buildings classified as Class 1 or Class 2 structures in the state of Indiana. The Commission also reviews applications for variances, appeals of state and local orders, and reviews local building ordinances.

  Attendees Heap Praise on "Construction Contracts & Law" Seminar  
  IBA offered the first of three "Construction Contracts & Law" seminars and the positive feedback from attendees was overwhelming. Two additional seminars are planned - October 18 in Corydon and November 9 in Granger. The 3-hour seminar, led by attorney Tom Bedsole with Frost Brown Todd, will include information on warranty laws and court decisions for new and existing homes as well as several other hot topics including:
  • Construction contract basics: learn which type of contract is best for your business, including recent legislation actions covering time and material contracts

  Scholarship Application Deadline - Sept. 30  
  IBA has funds available for projects and scholarships that benefit the housing industry through the Indiana Builders Charitable Foundation (IBCF) and IBA's Educational Scholarship Foundation. IBCF provides funding to educational causes that enhance knowledge and understanding of the housing industry and of the career opportunities available within the industry. IBA's Educational Scholarship Foundation honors IBA's long-time CEO, the late Bill Carson, by providing youth the opportunity to become the dream-makers of future generations. The Foundation awards scholarships to deserving students who have chosen the building industry as their vocation.   IBS Update: Deadline to Reserve Room in Indiana Room Block is October 14  
  The NAHB International Builders' Show® (IBS) will be held in Orlando, Florida on January 10-12, 2017. IBA members can register for the show and book a room in the assigned hotel block via www.BuildersShow.com. The IBA hotel is Las Palmeras (a Hilton Grand Vacation Club), and the rate is $222 per night. The deadline to reserve rooms within the room block is October 14.
