Inherent Risk Legislation introduced in Indiana General Assembly

On Jan. 5, 2026, State Rep. Lori Goss-Reaves [R] introduced Indiana House Bill 1076, which addresses liability related to off-road vehicle use. If passed, the legislation would establish the concept of inherent risk for off-road motorcyclists and provide enhanced protections for track owners and event organizers across the state. 

“Inherent risk” refers to dangers that are naturally associated with a particular activity or process. Certain risks cannot be eliminated or fully managed and therefore play a key role in determining legal responsibility for individuals who voluntarily participate in an activity. 

By clarifying these responsibilities, the legislation seeks to improve access to insurance coverage for landowners and promoters seeking to host off-road motorcycle events, benefiting the broader AMA community. Additionally, it would encourage safer venues and competitions, as facility operators must maintain appropriate safety practices or risk being held liable for accidents occurring on their property. 

Inherent risk is not a new concept. Similar legislation has been enacted to protect other recreational activities, such as skiing and equestrian sports. Most recently, inherent risk legislation specific to off-road motorcycles was passed in Arkansas last year (Act 312). 

The American Motorcyclist Association supports the introduction and passage of Indiana House Bill 1076 and remains engaged in efforts related to inherent risk and civil liability in other states, where similar bills have been introduced and are currently moving through the legislative process.
