Several States Introduce “Right to Race” Legislation to Protect Local Tracks

In January 2026, Indiana, Ohio, Kansas, and Oklahoma introduced “Right to Race” legislation which is intended to protect local racetracks and facilities from nuisance-based lawsuits from surrounding communities that arrive after the race facility has been established.  

These bills build off the success of previous racetrack protection bills, which passed in North Carolina and Iowa last year.  

The goal of this legislation is to give local racetracks and facilities more operative ability and predictability when facing restrictions or nuisance lawsuits from surrounding communities — actions which have shut down tracks in the past.
