Patients can’t wait: Tell Congress to step up and support the Safe Step Act.

"Fail first" (step therapy) policies require patients to try insurer-preferred drugs before getting the medication their provider prescribed. The result? Dangerous delays.

2024 polling from the PAN Foundation's Center for Patient Research shows most adults (55%) who faced step therapy were delayed by up to 11 weeks from starting the treatment their clinician originally recommended. Eleven weeks can mean worsening disease, severe side effects, ER visits, and lasting harm—especially for conditions like multiple sclerosis, Crohn’s disease, arthritis, and hepatitis C.

The Safe Step Act would protect patients by:

  • Creating a clear, fair exceptions process
  • Requiring quick decisions (72 hours—or 24 hours if life-threatening)
  • Allowing exceptions when delays or side effects would cause harm, when a patient has already failed a drug, or when a patient is stable on their current medication.
