Urge Congress to Support Office-Based Facilities Legislation!

The Society for Vascular Surgery (SVS) urges members to contact their U.S. representative and senators to request support for H.R. 7863, the Promoting Fairness for Medicare Providers Act of 2026, bipartisan legislation that would fix longstanding Medicare reimbursement inequities threatening patient access to office‑based care.

Under current Medicare policy, payment disparities between office‑based settings and ambulatory surgical centers (ASCs) make it increasingly difficult for physicians to provide certain interventional procedures, especially those requiring high‑cost medical supplies.

As a result, many private and independent practices are being forced to reduce services, close office‑based labs, or consolidate, which limits patient choice and drives care into higher‑cost hospital settings.

H.R. 7863 would help correct these inequities by aligning Medicare payment rates for specified procedures with the true cost of supplies when those services are safely performed in office‑based facilities. This reform is designed to:

  • Preserve patient access to timely, local care
  • Support practice sustainability, especially in independent and community settings
  • Avoid unnecessary site‑of‑service shifts that increase costs for Medicare and beneficiaries
  • Maintain strong safety and quality standards, while limiting excessive out‑of‑pocket costs for seniors

 

H.R. 7863, introduced on March 9, 2026, by Representatives Gus Bilirakis (R‑FL), Raul Ruiz, MD (D‑CA), Greg Murphy, MD (R‑NC), and Danny Davis (D‑IL), would amend the Social Security Act to better align Medicare reimbursement for certain office‑based interventional procedures with high‑cost supplies.

Physician organizations across multiple specialties have voiced strong support, emphasizing that the current reimbursement structure often fails to cover the direct cost of supplies (let alone physician work) and places private practice Medicare providers at risk and threatening patient access to care.
