Budget reconciliation — Congress’ way of fast-tracking certain spending and tax legislation — allows lawmakers to push through budget-related measures with a simple majority of 218 votes in the House and 51 in the Senate. On May 19 the House Budget Committee advanced its reconciliation bill with vital Medicaid PBM reforms. On May 21 at 1:00 in the morning the House Rules Committee will decide how the bill will be debated, how long lawmakers can discuss it, what amendments can be added, and other procedural details. 

Bill language would increase transparency and fairness in Medicaid managed care pharmacy reimbursement while banning the costly practice of spread pricing that continues to jeopardize patient access and drive-up Americans’ prescription costs. It would require 100% pass-through to pharmacies of ingredient costs and professional dispensing fees to pharmacies, a shift with the power to save the federal government and states billions of dollars. Provisions also guarantee that Medicaid managed care pharmacy reimbursement from PBMs will cover the true cost of acquiring and dispensing prescription medications, strengthening the sustainability of pharmacy care nationwide.

For years, PBMs have been operating unchecked, driving up drug prices, limiting patient choice, and forcing pharmacies to fill prescriptions at a loss. The result? Thousands of pharmacy closures, leaving communities — especially rural and underserved areas — without access to essential healthcare.
