06/27/25 ACTION ALERT (US): Act NOW to Rectify Anti-Patient, Anti-Pharmacy Reconciliation Bill Changes!

Although the House budget reconciliation package included long-overdue Medicaid pharmacy benefit manager (PBM) reforms to protect American taxpayers, patients, and pharmacies, a critical component of PBM reform may be stripped from the Senate version of the bill. Join NACDS RxIMPACT in telling targeted Senators to alter this bill NOW as a full Senate vote could happen at any time! 

Budget reconciliation — Congress’ way of fast-tracking certain spending and tax legislation — has moved to the Senate since the House passed its version of the bill. The Senate Parliamentarian recently ruled a crucial Medicaid PBM reform – safeguards for adequate pharmacy reimbursement and a ban on Medicaid spread pricing – would violate Senate rules likely meaning it would be stripped from the reconciliation bill before it’s considered by the Senate. We are now faced with the unquestionable need to eliminate language in the bill mandating participation in the National Average Drug Acquisition Cost (NADAC) survey. These two provisions were always meant to move together as one policy.

By potentially stripping out Section 71116, the ban on Medicaid managed care spread pricing and elimination of safeguards for fair and adequate reimbursement from PBMs, Congress will enable PBMs to proceed with their manipulation while pharmacies collapse under below-cost reimbursement. Further, if Section 71115 (the mandatory NADAC survey) is enacted separate from necessary Medicaid PBM reforms, the PBM middlemen will be handed yet another way to drive reimbursement even further below pharmacies’ costs. 

PBM reform remains long overdue, and Americans and their pharmacies are paying an increasing cost through drug price inflation, shuttered healthcare access points, and reductions in care. Congress cannot once again turn its back on Americans and their pharmacies — worsening an already desperate situation for every community throughout the nation!
