In June, New York's neighborhood pharmacies won a decisive victory in the Legislature. The Patient Access to Pharmacy Act, or PAPA (A5882C/S5939C), overwhelmingly passed the Senate 58-2 and the Assembly 133-0, and it will soon be transmitted to Governor Hochul for her signature.
If enacted, PAPA would stop pharmacy benefit manager (PBM) middlemen from paying pharmacies less than it costs to acquire and dispense a prescription to a patient covered by a state-regulated commercial plan. It is the same cost-based payment method New York Medicaid has used since 2023, proven and working at scale. The longer this goes unresolved, more pharmacies across the state close their doors, and the patients who depended on them are left driving farther or going without.
