Deadline Today, 10 Days Left to Session  
 

May 24 is the deadline for bills to pass out of the Second House (unless exempt). Here is the status of some bills of interest:

  • SB230, which would make various changes to real estate licensing (Advocate: 5/17, 5/3, 4/26, 4/19, 3/29, 3/15, 2/22), passed out of the Assembly (39 yeas-0 nays-2 excused/absent-1 vacant), on May 24 with an amendment. It now goes back to the Senate for a concur/do not concur vote (which means the Senate has to decide whether they agree with the amendment made in the other house). It would become effective January 1, 2020, for the pre-licensing requirements, and July 1, 2019, for the purpose of adopting regulations for the other provisions of the bill.
  • SB74, which would make a technical change to summary evictions (Advocate: 5/3, 4/19, 2/8), was approved by the Governor on May 14. It will be effective October 1, 2019.
  • SB103, a bill intended to promote affordable housing (Advocate: 5/175/3, 2/15), passed out of the Assembly (36-4-1-1) without an amendment on May 22. Since there were no amendments in the second house, it will now be enrolled and delivered to the Governor.
  • SB117, which requires the creation of a form that can be recorded to note discriminatory language in CC&Rs that is void and unenforceable (Advocate: 5/3, 4/26, 3/15, 2/15), was approved by the Governor on May 16. It will be effective October 1, 2019.
  • SB151, which would make changes to the summary eviction process (Advocate: 5/175/10, 4/26, 3/22, 3/15, 3/8, 3/1, 2/15), passed out of the Assembly with amendments on a party line vote. It is now back in the Senate for a concur/do not concur vote. It would be effective July 1, 2019.
  • SB199, which would require the county assessor or recorder to notify the county treasurer of any change in ownership of residential property (Advocate: 5/17, 5/3, 3/29), has been delivered to the Governor. It would be effective July 1, 2019.
  • SB212, which would address nonconsensual towing of vehicles in residential complexes (Advocate: 5/3, 3/8), passed out of the Assembly (40-0-1-1) without amendments on May 23, is being enrolled and will be delivered to the Governor.
  • SB398, which would extend the ability of local governments to take any action to ensure the availability of affordable housing - including rent control and inclusionary zoning (Advocate: 5/3, 4/26), was read a second time in the Assembly and was placed on the Chief Clerk's desk. It would be effective July 1, 2019.
  • SB493, which would create the Task Force on Employee Misclassification and might have an amendment threatening your independent contractor status (Advocate: 4/12), is exempt from deadlines. It has not been heard by Senate Finance yet. It would be effective July 1, 2019.
  • AB266, a bill to close a loophole from a 2017 bill on the sealing of eviction cases (Advocate: 5/3, 3/29), was approved by the Governor on May 15. It will be effective July 1, 2019.
  • AB335, which would make changes to HOA fees and resale packages (Advocate: 5/17, 5/10, 4/26, 4/5, 3/22), passed out of the Senate unanimously without amendments. It will now be enrolled and delivered to the Governor. Some sections of the bill would be effective upon passage and approval, others on January 1, 2020.

  Egregious Changes to Landlord-Tenant Law  
 

SB256, which proposed many changes to landlord-tenant law (Advocate: 5/175/104/26, 4/19, 4/12, 4/5, 3/29, 3/22, 3/15), was not heard or voted on by the Assembly Commerce and Labor by last Friday's deadline. According to the Legislature's rules, no further action is allowed on this bill. 

However, the session isn't over. The last 10 days are always critical and the proponents of the bill are not done fighting: they are attempting to place it into another bill. The issue is still very much alive - please stay abreast of any additional developments.
